GDPR Compliance Ireland: What AI Businesses Need to Know

Ireland sits at the intersection of two regulatory regimes that matter for AI businesses: GDPR and the EU AI Act. The Data Protection Commission (DPC) enforces GDPR, while 15 designated national authorities oversee the AI Act across different sectors.

If you're an Irish SME using AI, you're answering to both. Here's what that actually involves.

GDPR applies the moment AI touches personal data

This isn't theoretical. If your AI chatbot processes customer conversations, if your automation system handles employee records, if your recommendation engine tracks user behaviour — GDPR applies. The DPC's guidance on AI and data protection makes it clear that using AI doesn't create special exemptions. It creates additional obligations.

The core requirements haven't changed. You need a lawful basis for processing, privacy notices, data minimisation, retention policies, and security measures. But AI adds specific complications that a standard GDPR compliance programme might not cover.

What AI adds to your GDPR obligations

DPIAs become essentially mandatory. If you're processing personal data using new technology (AI qualifies), at scale, or with automated decision-making — you need a Data Protection Impact Assessment. The DPC investigated Snap specifically for launching an AI chatbot without an adequate DPIA. That's the precedent.

Cross-border transfers need documentation. Every call to OpenAI, Anthropic, or Google AI sends personal data to servers in the US. That's a transfer under GDPR requiring Standard Contractual Clauses or another transfer mechanism. Most Irish businesses using AI APIs haven't signed the provider's Data Processing Agreement. The DPA exists — they just haven't executed it.

Automated decisions trigger Article 22. If your AI makes decisions that significantly affect people — credit approvals, insurance quotes, eligibility for services — GDPR Article 22 gives individuals the right to human review, an explanation of the logic, and the right to contest the decision. "The algorithm decided" is not an acceptable explanation.

Data subject rights apply to AI outputs. If someone asks what data you hold about them, that includes data processed by your AI system. If they ask for deletion, you need to know what you can and cannot delete from AI models and logs.

The EU AI Act — what it adds from August 2, 2026

The EU AI Act's high-risk obligations become enforceable on August 2, 2026. For Irish businesses, this means:

Risk classification. Every AI system needs to be classified as prohibited, high-risk, limited-risk, or minimal-risk. High-risk systems (credit scoring, recruitment tools, insurance pricing) face the heaviest requirements. Most customer service chatbots are limited-risk — the main obligation is transparency.

Conformity assessment for high-risk. If you deploy a high-risk AI system, you need technical documentation, a risk management system, data governance documentation, human oversight mechanisms, and ongoing monitoring. This is significant work. See our EU AI Act compliance guide for SMEs.

Transparency for limited-risk. Chatbots must tell users they're talking to AI. AI-generated content must be labelled. This is lighter but still mandatory.

Ireland has designated the DPC as one of its competent authorities for AI Act enforcement alongside sector-specific regulators — the Central Bank for financial services AI, ComReg for telecoms, and others.

Irish-specific considerations

Enterprise Ireland support. SMEs can access digitalisation vouchers through Enterprise Ireland and Local Enterprise Offices that may cover compliance assessment costs. A scoping review or DPIA engagement could qualify.

The DPC sets the tone. Ireland is home to the European headquarters of many major tech companies. The DPC's enforcement actions against Meta, Google, TikTok, and others set precedents that apply to every Irish business. The standards are high because the DPC is under international scrutiny.

Sector regulators matter. The Central Bank of Ireland has its own expectations for AI in financial services. If you're a fintech using AI for credit decisions or fraud detection, you're answering to the Central Bank as well as the DPC. Your compliance documentation needs to satisfy both.

Practical steps for Irish AI businesses

Conduct a DPIA for every AI system processing personal data. Do it before deployment. The DPC's Snap investigation made the cost of skipping this very clear.

Sign DPAs with every AI provider. OpenAI, Anthropic, Google — they all offer Data Processing Agreements. Find them, sign them, keep records. This takes 10 minutes per provider and most businesses still haven't done it.

Classify your AI systems under the EU AI Act now. Don't wait until July. The EU AI Act Compliance Checker is a starting point. For high-risk systems, the conformity assessment takes weeks.

Update your privacy notices. Users need to know you use AI, what data it processes, who provides the AI service, and where the data goes. Generic privacy notices that don't mention AI are a compliance gap.

Build human oversight into automated decisions. If your AI influences decisions about people, the human review mechanism needs to be genuine — not rubber-stamping. The person reviewing needs access to the AI's reasoning and the authority to override it.

Check if Enterprise Ireland vouchers apply. A compliance assessment, DPIA, or AI Act classification engagement might qualify for funding support. Ask before you pay.
